Real Estate Brokerage: Brokers, Agents, and Realtors

Brokers are the facilitators and the overseers of real estate transactions. Brokers are above real estate agents in terms of education, experience, and responsibilities. They employ agents to help with the day to day running of the brokerage, including sourcing for buyers and sellers for a commission.

Agents are licensed when they are at par with set government regulations. For instance, some states require that agents work for single brokers.

For brokers to build a successful brokerage firm, different states have different requirements - often stricter than those of agents, such as sitting and passing brokerage exams.

Some states also require that the broker takes an Error and Omissions insurance cover, which comes in handy when settling a dispute between the broker and the client in case of an error or omission from the broker or his agents.

The title "realtors," on the other hand, is reserved for members of the National Association of Realtors (NAR). They include real estate professionals such as sales agents, brokers, and appraisers, all required to abide by its set code of ethics.

What Are the Duties of Real Estate Brokers?

Depending on the nature and demands of a real estate transaction, the broker may also act as an agent, representing the seller and buyer. Such is called dual agency.

The duties they perform, therefore, depend on what type of brokers they are.

Duties of Sellers' Brokers

The following duties apply to both brokers and agents acting in place of brokers in the transactions with sellers. The functions carried out on behalf of sellers are:

        Property listing on the local, LoopNet and Multiple Listing System (MLS)

        Embracing digital marketing, including social media marketing for maximum outreach

        Advising and guiding the seller throughout the preparation for property listing

        Sharing the property listing with other MLS brokers to reach more potential buyers

        Tabling offers to the seller

        Helping the seller in negotiating better offers and executing a purchase contract with the buyer

Upon signing the purchase contract, the seller's broker acts in the full capacity of the seller – including overseeing the transaction and ensuring a smooth closure.

Duties of Buyers' Brokers

Brokers also assist buyers by ensuring a smooth process in landing the properties they need. Their duties include:

        Helping buyers find the property that meets their location, price, and other preferences

        Helping the buyer make an offer and come up with a purchase agreement

        Negotiating for the buyer

        Ensuring a smooth transaction upon a successful agreement

        Helping the buyer prepare the documents needed for a successful transaction
